INSURANCE CONDITIONS 21180

 

Insurance policy included

 

All travelers benefit from a Europ Assistance Italia insurance policy, offered by the Tour Operator, for

the following guarantees:

 

1) ASSISTANCE INSURANCE

Travel assistance:

You can request the following benefits from Europ Assistance in the event of an accident, illness or Covid-19 that must directly affect you, a family member or a travel companion, as long as they are insured and traveling with you. The causes indicated must occur while traveling.

* Medical advice

* Sending a doctor or an ambulance to Italy

* Referral to a specialist doctor abroad

* Medical return

* Body transport

* Return of the other insured persons

* Travel of a family member

* Accompaniment of minors

* Return of the convalescent insured

* Extension of the stay

* Information and reporting of corresponding medicines abroad

* Interpreter available abroad

* Advance for basic necessities (valid only for policyholders resident in Italy)

* Early return

* Advance on bail abroad (valid only for insured persons resident in Italy)

* Referral of a lawyer abroad

* Sending of urgent messages

2) REIMBURSEMENT INSURANCE FOR MEDICAL EXPENSES

Following an accident and / or sudden illness, Europ Assistance Italia reimburses the medical, pharmaceutical and hospital expenses that the Insured must bear for urgent treatment or interventions received on site during the trip for the following maximum amounts:

Italy: € 1,000.00

Europe and the Mediterranean: € 30,000.00

World: € 50,000.00

For each reimbursement, a fixed deductible of € 50.00 will be applied for each Insured.

 

3) LUGGAGE INSURANCE

Europ Assistance Italia ensures compensation for damages suffered by baggage and personal effects that the Insured had with him at the beginning of the trip, including clothes, caused by theft, burglary, robbery, robbery, loss, loss and damage up to a ceiling of € 500.00 per person in Italy, Europe and countries of the Mediterranean basin, World.

 

4) INDEMNITY GUARANTEE FOR HOSPITALITY

If within 5 days of the return of your Trip you have been hospitalized for at least 7 consecutive days for Covid-19, Europ Assistance will pay you an Indemnity of Euro 1,000.00 per Insured, per claim and per period of duration of the Guarantee.

 

5) TRAVEL OR LEASE CANCELLATION EXPENSES GUARANTEE

You can request the travel or rental cancellation costs guarantee when you have to cancel or modify the booked trip, for reasons or events that can be objectively documented, unforeseeable, which are not known to you at the time of travel confirmation and which prevent you from participating in the trip, which affect :

– directly you and / or your family members;

– directly your Partner / Co-owner of the company / associated firm;

In addition, you can request the travel or rental cancellation expense guarantee when you have to cancel the booked trip, following a positive Covid-19 result ascertained by reports with positive results that have hit:

– directly you and / or your cohabiting family members;

– directly from your travel companion.

Europ Assistance indemnifies the penalty, applied contractually by the Tour Operator:

-to you

and, provided they are insured and registered on the same file:

-to your family members;

-to one of your travel companions.

If there are several insured persons registered for the trip together and at the same time, and none of them belong to your household, you must indicate only one person as a „travel companion“.

Europe Assistance reimburses in full the penalty charged up to the maximum limit provided for in the contract with the travel organization or reported by the Tour Operator in its catalogs. The reimbursement can never exceed Euro 7,000.00 per Insured.

If several insured persons enrolled in the trip together and at the same time cancel the trip, Europ Assistance reimburses the penalty up to an amount given by the sum of the maximum insured limits for each person, with a maximum total of Euro 15,000.00 per claim.

In the case of rental only, Europ Assistance pays you the penalty only if there is a total cancellation of the practice involving all the occupants of the accommodation who are registered together with the trip.

The maximum limit for each practice is equal to Euro 15,000.00. The pro-quota will not be refunded.

Europ Assistance does not reimburse:

– the costs of handling the file,

– agency fees,

– travel registration fees

– insurance premiums

 

Attention!

This warranty provides for an Overdraft. Consult art. „Limitations of Warranties“ of Section II.

The overdraft is not applied:

– in the case of modification and / or forced renunciation of the trip due to hospitalization (excluding Day Hospital and First Aid)

– in the event of death.

 

6) TRAVEL REPAIR GUARANTEE

(The guarantee does not apply in the event of a lease)

You can request this guarantee when you have to interrupt your trip solely and exclusively as a result of:

– Medical return organized by the Organizational Structure, on the basis of these contractual conditions;

– Early return organized by the Organizational Structure, on the basis of these contractual conditions;

– hijacking as a result of piracy of the plane on which you are traveling.

Europ Assistance reimburses the unused travel portion calculated as indicated in Art. „CRITERIA FOR SETTLEMENT OF DAMAGES“.

The part of the trip not taken will be reimbursed up to a maximum of Euro 7,000.00 per Insured.

If several policyholders enrolled in the trip together and interrupt the trip at the same time, Europ Assistance reimburses the part of the trip not taken up to an amount given by the sum of the maximum insured limits for each insured person, with a maximum total of Euro 15,000.00 per claim.

 

7) STAY EXTENSION GUARANTEE IN CASE OF COVID-19

If a Covid-19 outbreak / pandemic hits directly:

-you,

-a travel companion of yours who occupies the same room / accommodation

-a family member traveling with you

and all those registered in the same file / occupying the same location are forced to a quarantine, Europ Assistance reimburses the hotel / rental expenses (board and lodging) for the extension of the stay in the amount of Euro 100.00 per day for a maximum of 15 days, per Insured and per period of duration of the

Guarantee, with a maximum total in the event of a rental of Euro 3,000.00.

In the case of simultaneous registration of a pre-established group of participants, the definition „travel companion“ can refer to only one person.

 

8) TRAVEL FEE REFUND GUARANTEE IN CASE OF COVID-19

If you, your family members traveling with you or your registered travel companion at the same time are forced to interrupt the trip in the event of:

– hospitalization for epidemic / pandemic from Covid-19;

– forced quarantine from Covid-19;

Europ Assistance reimburses the unused travel portion calculated as indicated in Art. „CRITERIA FOR SETTLEMENT OF DAMAGES“.

The part of the trip not taken will be reimbursed up to a maximum of Euro 7,000.00 per Insured.

If several policyholders enrolled in the trip together and interrupt the trip at the same time, Europ Assistance reimburses the part of the trip not taken up to an amount given by the sum of the maximum insured limits for each insured person, with a total maximum of Euro 15,000.00 per practice; the maximum limit for a single rental is Euro 7.0000.00.

In the case of simultaneous registration of a pre-established group of participants, the definition „travel companion“ can refer to only one person.

In order to provide the services / guarantees provided for in the Policy, Europ Assistance Italia must process the Insured’s data and for this purpose, pursuant to EU Regulation 2016/679 on the protection of personal data, it needs your consent. Therefore, by contacting or having Europ Assistance Italia contacted, the Insured freely gives his consent to the processing of his personal data also, where necessary, relating to health and criminal offenses and convictions, as indicated in the Information on the processing of data received.

The text of the guarantees and services referred to in points 1, 2 and 3 is purely indicative.

Effects and limitations are listed in the card / booklet of the policy conditions which will be delivered to all insured persons participating in the trips.

● MEDICAL EXPENSES REIMBURSEMENT

Following injury and/or sudden illness, Europ Assistance will reimburse the medical, pharmaceutical and hospital care expenses that the Insured has to bear for urgent care or interventions received on the spot during the trip for the following maximum coverage of:

 World:€   10.000,00

For all refunds, a fixed deductible of € 50.00 will be applied per Insured.

 

● LUGGAGE INSURANCE

Europ Assistance provides compensation for damage to baggage and personal effects that the Insured brought at the beginning of the trip, including clothing, resulting from theft, burglary, robbery, theft, loss, loss and damage for a maximum coverage of € 1.000,00 per person in Italy, Europe and countries of the Mediterranean basin, World.

 

● TRIP OR ACCOMODATION CANCELLATION INSURANCE

The cover of “Travel or lease cancellation” applies from the date on which the travel/lease is confirmed and runs until the start date of the travel/lease, with “start date of travel” meaning the date on which the Insured Party was required to go to the place of departure and “start date of lease” meaning the date on which the stay begins.

If the Insured Party should need to cancel or alter the trip booked, for reasons or events that can objectively be documented and could not be foreseen at the time of confirming travel, affecting:

● the Insured Party him/herself directly and/or his/her family members;
● the joint-owner of the associated firm/business directly;

Europ Assistance will reimburse the penalty, applied contractually by the Tourist Operator:

● to the Insured Party

and, as long as they are insured and registered in the same travel file:

● to live-in family members;
● to one of the Travel Companions.

If several insured parties are registered to travel together at the same time, for lack of any other persons of the same family nucleus living with the Insured Party, the latter shall specify a single person as his/her “Travel Companion”.

 

○ EXCLUSIONS

The guarantee excludes cases of renunciation caused by:

1. misconduct of the Insured Party or serious negligence;
2. theft, robbery, loss of identification and/or travel documents;
3. mental diseases and psychological disturbances in general, including cerebral organic syndromes, schizophrenia, paranoia, manic-depressive forms and related consequences/complications;
4. state of pregnancy or consequent pathological situations in cases where conception was prior to the date on which travel was booked;
5. injury, illness or death occurring prior to confirmation of travel;
6. illnesses that are the expression or direct consequence of chronic or pre-existing pathological situations in place at the time the travel was confirmed;
7. consequences and/or complications of injuries that took place prior to confirming the travel;
8. situations of armed conflict, invasion, acts by foreign enemies, hostilities, war, strikes, uprisings, popular tumult, acts of terrorism, earthquakes, volcanic eruptions, atmospheric phenomena classed as natural disasters, atom nucleus transmutation, radiation caused by the artificial acceleration, radiation caused by the artificial acceleration of atomic particles;

● bankruptcy of the Carrier or Travel Agency or Organiser;

1. epidemics classed as pandemics, of such a severity and virulence as to entail a high level of mortality or to requirerestrictive measures in order to reduce the risk of transmission to the civil population, quarantine;
2.deposits and/or advances that are not justified by penalty tax documents;

● failure by the Insured Party to send the communication (pursuant to the section OBLIGATIONS OF THE INSURED PARTY IN THE EVENT OF A CLAIM) before the travel/stay start date, except for cases of cancellation caused by death or hospitalisation of at least 24 consecutive hours (excluding day hospital and accident & emergency) of a family member.

 

○ OBLIGATIONS OF THE INSURED PARTY IN THE EVENT OF A CLAIM

In the event of a change and/or forced renunciation of travel or rental, the Insured Party must:

– within five calendar days of the onset of the cause of the renunciation and in any case before the travel start date, make a declaration – by accessing the portal https://sinistrionline.europassistance.it and following the instructions (or accessing the website www.europassistance.it, claims section, directly) or must send a fax to 02.58.47.70.19, with a written declaration addressed to: Ufficio Liquidazione Sinistri (Annullamento Viaggio) (Claims Liquidation Office (Travel Cancellation)) – Europ Assistance Italia S.p.A. – Piazza Trento, 8 – 20135 Milan, specifying:

– first name, last name, address, telephone number, tax code;
– Europ Assistance card number
– the reason for the cancellation or change;
– place at which the Insured Party or persons causing the cancellation (family member, joint-owner of the associated firm/business) can be contacted;

If the renunciation and/or change to travel or rental is caused by illness and/or injury, the declaration must also specify:

– the type of pathology;
– the pathology start and end.

Within 15 days of the above declaration, the Insured Party must also provide Europ Assistance Italia S.p.A. with the following documents:

– copy of the Europ Assistance card if held by the Insured Party;
– original documentation able to provide objective proof of the cause of renunciation/change;
– documentation showing the connection between the Insured Party and any party causing the renunciation;
– in the event of illness or injury, medical certificate stating the date of the injury or onset of the illness, the specific diagnosis and days’ prognosis;
– in the event of hospitalisation, a true copy of the original medical record;
– in the event of death, the death certificate;
– travel registration card or similar document;
– receipts (deposit, balance, penalty) of payment of the travel or rental;
– billing statement of confirmation as issued by the Travel Agency/Organisation;
– invoice of the Travel Agency/Organisation in relation to the penalty charged;
– copy of the cancelled ticket;
– travel regulation and programme;
– travel documents (visas, etc.);
– travel confirmation contract.

If a penalty is charged by the airline carrier/shipping company:

– confirmation of purchase of ticket or similar document;
– receipt of ticket payment;
– declaration of the airline carrier/shipping company certifying the penalty charged or refund notice;
– copy of the cancelled air or ship tickets documenting the amounts charged to the customer.

Europ Assistance has the right to gain possession of travel and/or lease documents not used by the Insured Party.

Breach of the obligations relating to the declaration of the Claim may result in the loss of a right to Indemnity, in accordance with Art. 1915 of the Italian Civil Code.

 

○ CRITERIA FOR LIQUIDATION OF THE DAMAGES

The penalty charged against the Insured Party will be reimbursed in full, including file management fees, agency fees, fuel adjustments and visas (excluding, in the event of the purchase of a flight ticket, airport taxes that can be reimbursed by the airline) up to the limit to liability envisaged in the contract with the Tour Operator, per Insured Party and fr the travel destination and/or reported by the Tour Operator in its catalogues.

Said maximum cover cannot in any case exceed Euro 7,000.00 per Insured Party. In the event of the renunciation of more than one Insured Party registered for travel together and simultaneously, the reimbursement will be paid out up to the amount equal to the sum of the maximum amounts insured per Insured Party, but with the total maximum of Euro 15,000.00 per claim.

Europ Assistance reimburses the cancellation penalty:

in the event of a change and/or forced renunciation of travel caused by hospitalisation (excluding day hospital and accident & emergency) or death; the penalty will be reimbursed without applying any excess;

in the event of renunciation not caused by hospitalisation or death, the penalty will be refunded with the application of a deductible amount equal to 20% of the total penalty; if the penalty should exceed the maximum cover, the deductible amount will be calculated on the latter.

It is agreed that the calculation of the reimbursement will be equivalent to the percentages existing as at the date on which the event took place (Art. 1914 of the Italian Civil Code). Therefore, if the Insured Party should cancel the trip after the event, any greater penalty will be at his/her expense.

 

○ PROFESSIONAL SECRECY

The Insured Party releases any doctors, who may be appointed to examine the claim and who examined him before or after the claim, from constraints to professional secrecy with regards to Europ Assistance.

 

● TRAVEL REPETITION INSURANCE

If the Insured Party should interrupt the trip insured exclusively as a result of:

– organisation and delivery by Europ Assistance of the provision of Return for health reasons, according to contractual conditions;
– organisation and delivery by Europ Assistance of the provision of Early return, according to contractual conditions;
– redirection of the aeroplane on which the Insured Party is travelling, following an act of piracy.

Europ Assistance will refund the portion of the trip not used, calculated as specified in the Article entitled “CRITERIA FOR THE LIQUIDATION OF DAMAGES” .

The part of the travel not used will be reimbursed up to a maximum of the travel purchase value and as specified in the Policy Form, Mod. 16261.

Said maximum cover cannot in any case exceed Euro 7,000 per Insured Party. In the event of the interruption of more than one Insured Party registered for travel together and simultaneously, the reimbursement will be paid out up to the amount equal to the sum of the maximum amounts insured per Insured Party, but with the total maximum of Euro 15,000.00 per claim.

 

○ EXCLUSIONS

Cover excludes interruptions of travel caused by:

1. illnesses that are the expression or direct consequence of chronic or pre-existing pathological situations in place at the time the travel was confirmed;
2. pregnancy or consequent pathological situations;
3. mental diseases and psychological disturbances in general, including cerebral organic syndromes, schizophrenia, paranoia, manic-depressive forms and related consequences/complications;
4. illness or injury the treatment of which constituted the purpose of the trip.

Cover is also not due for claims caused by or resulting from:

1. flooding, deluge, volcanic eruptions, earthquakes, atmospheric phenomena classed as natural disasters, atom nucleus transmutation, radiation caused by the artificial acceleration of atomic particles;
2. wars, strikes, revolutions, popular turmoil or movements, looting, acts of terrorism and vandalism;
3. removal and/or transplant of organs;
4. misconduct of the Insured Party or serious negligence.

 

○ OBLIGATIONS OF THE INSURED PARTY

Following the interruption of the trip, within sixty days of his return to domicile, the Insured Party must submit a claim by accessing the portal https://sinistrionline.europassistance.it and following the instructions given (or by accessing the website www.europassistance.it, claims section, directly) or must send a fax to 02.58.47.70.19, with a written declaration addressed to: Europ Assistance – Piazza Trento, 8 – 20135 Milan – specifying “Ufficio Liquidazione Sinistri – Rifacimento Viaggio” (Claims Liquidation Office – Travel Repetition) on the envelope and giving:

– first name, last name, address, telephone number;
– Europ Assistance card number;
– the reason for the interruption of travel;
– travel programme;
– return date;
– certificate of payment of travel;
– billing statement of confirmation as issued by the Travel Agency/Organisation;

Breach of the obligations relating to the declaration of the Claim may result in the loss of a right to Indemnity, in accordance with Art. 1915 of the Italian Civil Code.

 

○ CRITERIA FOR LIQUIDATION OF THE DAMAGES

Europ Assistance will calculate the daily value of the trip, dividing the total value declared on the policy by the number of days initially envisaged and will then proceed to pay the residual days not used by the Insured Party. The date on which travel is interrupted and that of return envisaged at the start of travel, will be considered as a single day.

 

○ PROFESSIONAL SECRECY

The Insured Party releases any doctors, who may be appointed to examine the claim and who examined him before or after the claim, from constraints to professional secrecy with regards to Europ Assistance.

 

 

HOW TO CALL EUROP ASSISTANCE

If necessary, wherever you are and at any time, the Europ Assistance Organisational Structure is operative 24 hours a day.

The specialised staff of the Organisational Structure is at your complete disposal, ready to intervene or inform you of the most appropriate procedures by which to solve any problem in the best possible way, as well as to authorise any expenses.

IMPORTANT: do not take any initiative without first having telephoned the Organisational Structure at:

In order to provide the services/guarantees given in the Policy, Europ Assistance must process the data of the Insured Party and to this end requires, in accordance with Italian Legislative Decree no. 196/03 (the Privacy Code) your consent. In contacting or having Europ Assistance contacted, the Insured Party therefore gives free consent to the processing of his common, sensitive and legal personal data, as indicated in the Privacy Disclosure received.
